Regulations of the tour "A DAY FULL OF EXPERIENCES IN THE HEART OF POLISH ORCHARD GROWING"


    §1. General provisions

    1. These Regulations define the rules of participation in educational trips organized by Nasza Tłocznia at the facility located at: 05-660 Warka, Konary 92.
    2. The tour organizer is the Zbigniew Pietrzycki Fruit Farm / Nasza Tłocznia.
    3. The facility includes in particular:
      ◦ ecological apple orchard,
      ◦ production hall,
      ◦ office building with a company store,
      ◦ farm buildings,
      ◦ recreational and educational areas,
      ◦ parking lots,
      ◦ the entire area belonging to the facility.
    4. The premises are private property.
    5. Making a reservation and entering the facility constitutes acceptance of these Regulations by tour participants and their guardians.
    6. The regulations apply to all participants staying on the premises.
    7. The Organizer reserves the right to refuse entry or to ask anyone who violates the provisions of the Regulations or safety rules to leave the facility.

    §2. Booking and organizing the trip

    1. Tours are organized only by prior reservation.
    2. Reservations can only be made via the reservation form available at www.edu.naszatlocznia.pl
    3. Confirmation of the reservation is the payment of a deposit.
    4. The deposit paid when making the reservation is non-refundable.
    5. The organizer reserves the right to change the tour program or schedule for reasons beyond its control, in particular:
      ◦ weather conditions,
      ◦ technical failures,
      ◦ force majeure,
      ◦ safety reasons.
    6. The Organizer reserves the right to cancel the trip in circumstances beyond the Organizer's control. In such a case, the parties will agree on a new date for the service or an alternative solution.
    7. Groups should arrive on time for the scheduled tour start time.
    8. In the event of delay, the Organizer reserves the right to shorten the tour program in proportion to the delay.
    9. The number of guardians per group of children or youth should be in accordance with applicable legal provisions and safety rules.
    10. Guardians are fully responsible for underage participants throughout their stay on the premises.

    §3. Rules of participation

    1. Tour participants stay on the premises and use all offered attractions and facilities at their own risk.
    2. Guardians bear full responsibility for minors.
    3. Guardians are obligated to:
      ◦ familiarize participants with the content of these Regulations,
      ◦ exercise constant supervision over the group,
      ◦ respond to inappropriate behavior of participants.
    4. Participants are obliged to follow the instructions:
      ◦ guides,
      ◦ service staff,
      ◦ owners of the facility.
    5. The attractions must be used in accordance with their intended purpose and the instructions provided by the staff.
    6. Participants are obliged to exercise particular caution in the orchard area, production hall and near technical equipment and machines.
    7. It is forbidden to leave the group without the knowledge of the supervisor.
    8. Participants should wear appropriate clothing appropriate to the weather conditions and the nature of the field trip.
    9. The organizer recommends wearing comfortable sports shoes and clothing items that will allow for participant identification – vests, handkerchiefs with the name of the facility, ID badges, and others.
    10. In the event of food allergies or other special health needs, participants or guardians are required to inform the Organizer before the start of the tour.

    §4. Safety and order rules

    1. On the premises it is prohibited to:
      1. using the offered attractions for purposes other than their intended purpose,
      2. climbing and hanging on:
        ▪ goals,
        ▪ benches,
        ▪ pyramids,
        ▪ straw bales,
        ▪ wooden boxes,
        ▪ umbrellas,
        ▪ tents,
        ▪ other infrastructure elements,
      3. destruction of equipment, decorations, devices and vegetation,
      4. throwing garden stones or other objects,
      5. littering,
      6. consumption of alcohol and other stimulants,
      7. bringing in alcohol, narcotics and psychoactive substances,
      8. smoking cigarettes, e-cigarettes and tobacco products outside designated areas,
      9. bringing in and using pyrotechnic materials,
      10. unauthorized start-up of devices and machines,
      11. entering technical and production rooms without the consent of the staff,
      12. entering vehicles in places other than designated parking lots,
      13. disrupting the course of the tour and making it difficult for others to use the attractions
        participants,
      14. behaviors that pose a threat to the health or life of participants.
    2. Participants are obliged to:
      1. waste segregation in accordance with the markings located on the premises,
      2. maintaining cleanliness and order,
      3. compliance with the rules of personal culture,
      4. respect the property of the Organizer and other participants,
      5. compliance with safety and hygiene rules.
    3. The Organizer may temporarily exclude selected attractions from use for technical, weather or safety reasons.
    4. The property may contain uneven terrain, mud, wet surfaces and natural landscape features typical of a fruit farm.
    5. The organizer is not responsible for any injuries resulting from failure to comply with safety rules.

    §5. Educational program and attractions

    1. The tour program may include, among others:
      ◦ visiting an ecological apple orchard,
      ◦ learning about the juice extraction process,
      ◦ independent fruit harvesting,
      ◦ product tastings,
      ◦ animation activities,
      ◦ recreational activities.
    2. The scope of the program may vary depending on the selected package, the age of participants and seasonality.
    3. Some attractions may be dependent on weather conditions or the growing season.
    4. Products served during the tasting may contain natural allergens, including fruits and plant products.
    5. The organizer is not responsible for any allergic reactions of participants about which he has not been informed in advance.

    §6. Liability

    1. Participants who do not comply with the rules set out in these Regulations shall bear full material and legal responsibility for any damage caused.
    2. Guardians are fully responsible for the safety of participants and any damage caused by persons under their care.
    3. The organizer is not responsible for:
      ◦ items left unattended,
      ◦ lost items,
      ◦ damage to participants' property,
      ◦ accidents resulting from failure to comply with the Regulations or staff instructions.
    4. The organizer reserves the right to terminate a participant's participation in the trip in the event of a gross violation of safety rules or behavior that poses a threat to other participants.

    §7. Image and promotional materials

    1. Tour participants consent to the possibility of recording, recording, reproducing, transmitting and sharing their image for the Organizer's marketing and promotional purposes.
    2. The image may be used in particular:
      ◦ on the Organizer's website,
      ◦ on social media,
      ◦ in advertising materials,
      ◦ in printed and electronic materials.
    3. Materials may be published, among others, in the following channels:
      ◦ YouTube,
      ◦ Instagram,
      ◦ Facebook,
      ◦ TikTok,
      ◦ www.naszatlocznia.pl,
      ◦ www.edu.naszatlocznia.pl.
    4. The Organizer declares that materials containing the image of participants will be used solely for the purpose of promoting the Organizer's activities.
    5. The Organizer undertakes to use the image of participants with respect for their personal rights and in accordance with applicable law.
    6. In the event of non-consent to the use of the image, the participant or legal guardian is obliged to inform the Organizer before the start of the trip.

    §8. Personal data

    1. The administrator of the participants’ personal data is Gospodarstwo Ordownicze Zbigniew Pietrzycki / Nasza Tłocznia.
    2. Personal data is processed solely for the purpose of:
      ◦ fulfillment of reservations,
      ◦ organizing the trip,
      ◦ customer contact,
      ◦ fulfillment of legal obligations,
      ◦ marketing activities in accordance with the consents granted.
    3. Personal data are processed in accordance with applicable law, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).
    4. Detailed information regarding the processing of personal data is available in the Organizer's Privacy Policy.

    §9. Payments

    1. Ticket prices are determined in accordance with the Organizer's current offer and depend on the number of participants registered for the trip.
    2. The final price of the tour is determined based on the actual number of participants present on the day of the tour.
    3. In the event of a reduction in the number of participants compared to the number declared during the booking, the Organizer has the right to recalculate the price in accordance with the applicable price threshold.
    4. This means that if 50 participants are registered at the time of booking and 49 participants arrive on the day of the tour, the price will be charged at the higher rate applicable to the smaller group.
    5. The condition for confirmation of the reservation is the payment of a deposit in the amount determined by the Organizer.
    6. The deposit is non-refundable, regardless of the reason for the participant's or group's withdrawal.
    7. The remaining amount is payable on the day of the visit:
      ◦ cash,
      ◦ by payment card, as previously agreed.
    8. The deposit must be paid no later than two weeks before the visit date,
    9. Failure to pay on time may result in cancellation of your reservation.
    10. In the event of cancellation of the trip by the ordering party less than 7 days before the planned date of implementation, the Organizer reserves the right to charge the ordering party for the costs incurred in connection with the preparation of the service.
    11. The organizer issues VAT invoices at the request of the ordering party.
    12. Any complaints regarding payment must be submitted via email within 14 days of the date of the trip.

    §10. Final provisions

    1. The regulations are available:
      ◦ on the Organizer's website,
      ◦ at the place of business,
      ◦ available for viewing upon request by participants.
    2. The Organizer reserves the right to change these Regulations.
    3. In matters not regulated by these Regulations, the relevant provisions of Polish law shall apply.
    4. The current version of the Regulations is effective from the date of its publication.
